TERMS AND CONDITIONS
THESE TERMS AND CONDITIONS DO NOT IN ANY WAY AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER.
The content of this page is for your general information and use only and is subject to change. Please take a few minutes to read through the terms and conditions as these form the basis of the contract. Further information can be provided on request. Please note that the total price of your order is subject to change upon finalisation of your flavour choices and the end design. The final price must be agreed and balance paid within four weeks (two weeks for celebration cakes) of the collection/delivery date.
DEPOSIT
Your order becomes reserved only when a booking deposit is received. The deposit is paid to reserve your date and is NON-REFUNDABLE in the event of a cancellation. Wedding cake deposits are split in to two payments, the first payment holds your date. The second payment secures and guarantees your booking and is due after receipt of the final invoice. All orders are first come first serve and we only do a limited number of cakes per week. However, if you need to change dates or move your event, please contact us and we'll be happy to make accommodating arrangements when ever possible. Deposits are refunded/transferable at the sole discretion of Bake To The Future and all decisions are final.
FINAL PAYMENT
The final balance is due six weeks (two weeks for celebration cakes) before the date of collection/delivery. If your cake is ordered less than six weeks before the date of collection/delivery, the total balance is due immediately and your order will not be placed until payment is received. Your order will not be completed if final payment has not been received. We are happy to accept payments for the total contracted price – however, all monies must be received six weeks prior to the event or your order will not be created and all payments made will be non-refundable after the six week lock-out date unless special arrangements have been made beforehand.
RETURNING ITEMS
Please return any stands, plates, brooches or other decor to Bake To The Future no later than one week after your event. A deposit may be required for your rented items and will only be refunded after items have been returned in the condition they were hired in.
CAKE CHANGES
Changes to your cake order: size, description, flavours, etc. will be accepted up until six weeks prior to the date of delivery for wedding cakes and two weeks before the date of collection/delivery for celebration cakes. After that lockout date we cannot accept any changes unless there are extenuating circumstances. Any changes made, may impact the total price of your order. For short notice orders placed with less than two/six weeks notice no changes can be made after the full payment has been received.
DELIVERY AND SET UP
Delivery and set-up is required for ALL wedding cakes and for some multi tiered or structured special occasion cakes. If you would like to collect your cake, please make arrangements beforehand. All collections are by appointment only. If you do not arrive at the agreed time then we may not be here for you to collect at a later time. No refunds will be made if you fail to collect your order at the agreed time. Cakes must be transported in the box it is supplied in, on a flat and secure surface. Bake To The Future can not be held responsible for damage incurred after collection due to negligence or failure to take adequate care.
CANCELLATION
In the event of cancellation: Orders cancelled before the six week (two weeks for celebration cakes) lockout date will be refunded at the discretion of Bake To The Future. Cakes cancelled after the six week (two weeks for celebration cakes) lockout date will not be refunded. In the event that something occurs to affect your scheduled event date, please contact us to discuss options. Communication is key; if you are up-front about any issues with your date we will work hard to accommodate you. We understand things can come up that are out of your control. All deposits are non refundable. Any payments received before the six week deadline will only be refunded at Bake To The Future's discretion and with no loss to ourselves, we reserve the right to offer a credit in stead of a full refund when we have already incurred costs/expenses and any hours worked will be deducted from the amount.
Cancellation by Bake To The Future: We shall not be liable for any failure to perform, where such failure or delay results from any circumstances outside our reasonable control including but not limited to any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever. In the event of exceptional circumstances, such as serious illness, we will give as much notice as possible if we are unable to fulfil your order. We will endeavour to find someone else who can produce your order and will refund you any monies already paid.
GUARANTEE
We promise to do everything in our power to deliver tasty baked goods that exceed your expectations. We will work with you on every level to make sure you are completely satisfied and happy with your order. Please note that colours and design of the actual cake may vary slightly from computer images due to the nature of digital and edible components. If an image is supplied for design then please note that we will treat it as inspiration and although the basis of the design will be as close a match as possible, colours may vary due to the brands used. Each cake designer has their own style, you can view our work in the gallery on the website or on our Facebook page to get a clearer idea of our style. Any featured text may also differ. Bake To The Future cannot be held responsible for anything that should happen to the cake once collection/delivery is complete. Please note that direct sunlight and high temperatures can have adverse effects on any cake.
COMPLAINTS
In the case of an emergency or an error in your cake delivery, please contact us immediately so we can fix the issue right away. If you are unhappy with your cake for any reason, please call us the day of your event and explain the situation. In the rare case that you are unhappy with your cake and would like a refund, you must call the day of collection/delivery so your cake can be returned. Without proof that you are indeed unhappy with the product and will not be using it for your event, we will be unable to refund any portion of your payment. We are dedicated to satisfying our client’s requirements so please give us the opportunity to address any issue you may have. All orders require a signature upon delivery/collection, this indicates your satisfaction with the products received. If you are not happy then we must be informed before you accept your cake. This gives us the opportunity and time to rectify any issues. We can not accept returned cakes on the basis of dissatisfaction with design or finish after you have signed for the cake. We can not be held responsible for any mistakes made by the customer such as misspelled names or the wrong age or even the wrong date for collection/delivery. We take photos of every cake before it leaves our premises. Bake To The Future has never received a complaint and we pride ourselves on our 5* reviews and loyal customer base. Some complaints can be quite complicated and require some investigation so an immediate refund may not be possible. We must receive the cake/cupcakes back within 24 hours of collection or delivery in order for us to assess the nature of the complaint. During this time the cake must be stored correctly, in the box provided according to the instructions provided by Bake To The Future. We can not be held responsible for damage incurred due to mishandling or wrongful storage of the cake whilst in your possession. If you would like a refund we must receive at least 75% of the cake back within 24 hours of collection/delivery. We do not refund customers who change their minds or have allowed their cake to become damaged. All orders are the full responsibility of the customer once out of our care.
PRIVACY POLICY
Bake To The Future cares about you and takes your privacy very seriously. We will not bombard you with emails, texts or unwarranted phone calls and we will never sell or share your data. Any information we request is necessary to complete your order, to contact you to finalise details or to make collection/delivery arrangements. All information that you provide will be stored securely and can be removed at your request.
DESIGN
All designs belong to Bake To The Future. We reserve the right to refuse access to any sketches drawn up where applicable. If it is discovered that you have stolen a design created by Bake To The Future, you will be liable for fees associated with the design process. Cancellation of your order will be handled according to the terms and conditions outlined under cancellation here unless it is discovered that you knowingly and deliberately stole designs belonging to Bake To The Future and knowingly and deliberately handed the design to a different cake company for them to create. We have the right to initiate legal proceedings against you for theft of intellectual property and loss of earnings in the event of this situation occurring.
(March 2020) COVID-19 and Pandemics:
All orders impacted by the lock-down restrictions imposed across the UK due to the corona-virus or any other pandemic, will have their full payment transferred to a future date. For celebration orders there is no additional charge and all monies paid will be credited to a future order as full or part payment. If you choose to cancel your order then no refund will be given. For weddings, all monies paid including deposits will be transferred to a future date. You need to work with me to agree on a date that works, should you book a date that I am not available for then no refund will be issued as this is classed as a cancellation on your part. All postponements must be within 12 months, any postponements outside of 12 months or on peak dates for the following year, (Saturdays from July to September) will incur an additional fee to cover the yearly price increase of goods and ingredients and to recoup the losses caused by turning additional bookings away. Please inform me as soon as possible of your plan to postpone, the more notice I have, the better. Once you have an idea of your new date please contact me immediately to check my availability. I want to make the situation as easy as possible for you as I understand the difficulty and stress you are feeling but please understand that I am experiencing difficulties and stress also and I need us to work together for the best outcome all round.
